Certificate of conformity of petroleum equipment
Since April 1st, 2007, the regulations for petroleum equipment and administrations related to its application have been transferred to the Régie du bâtiment du Québec (RBQ).
The regulatory provisions include procedures that will allow the Régie to verify and control compliance requirements for petroleum equipment classified as high risk.
We are happy to promote and ensure professional competence. As a result, Mr. Julien Fournier and Ms. Chantal Fortin are members of the Ordre des Technologues Professionnels du Québec and are registered as recognized persons by the Régie du bâtiment du Québec.

A little history
The first law concerning petroleum equipment came into force in 1973. It was entitled: Loi sur le commerce des produits pétroliers. Since then, this law has undergone several changes. The 1991 revision (Loi sur l’utilisation des produits pétroliers) made it possible to subject non-commercial petroleum equipment to the law. In 1999, the reform was aimed more at empowering customers who operate petroleum equipment.
Since April 1st, 2007, amendments to the Loi sur le bâtiment are in place to regulate provisions for petroleum equipment.

Obligation of the owner or operator
Periodic verification of high-risk petroleum equipment
All existing high-risk oil equipment must be periodically verified whose frequency is based on the type of equipment and its location. This verification must be carried out by a recognized person by the Régie du bâtiment, who will produce a certificate of conformity. This certificate must be provided for the renewal of your license.

High-Risk Petroleum Equipment Licenses
The Régie du bâtiment manages nearly 10,000 permits for the use of high-risk petroleum equipment. According to article 8.01 of the Code de construction, high-risk equipment has one or more of the following characteristics:

Verification system for petroleum equipment
The Régie du bâtiment du Québec (RBQ) entrusts the private sector, to recognized persons, with the task of carrying out conformity audits during the installation, modification or demolition of high-risk petroleum equipment, and periodic audits to enable it, respectively, to issue or renew permits for the use of high-risk petroleum equipment.
Audits during the execution of the works
During the performance of work involving high-risk petroleum equipment, a recognized person shall ensure that the contractor or the owner-builder performs the work in accordance with the applicable requirements of article 8.12 of the Code de construction du Québec.
The contractor or the owner-builder must provide the RBQ with a certificate of conformity produced and signed by a recognized person (formerly known as a "certified verifier"). This certification must be presented at the end of construction related to the erection, modification, demolition or abandonment of high-risk petroleum equipment or related piping.
Although this responsibility ultimately rests with the contractor, it is in the interest of the owner of the equipment to ensure that the certificate is sent to the RBQ by the contractor or recognized person, since it is necessary for the issue of the license of use.
Periodic verifications
During operation, any high-risk petroleum equipment must be periodically verified. A recognized person carries out this verification to produce the certificate of conformity required for the renewal of the permit, where required.
